Court Investigation and Evaluation: A Closer Look
This stage is all about gathering information and ensuring a fair assessment of the situation. The court appoints an investigator, often called a guardian ad litem, who acts as an impartial advocate for the proposed ward. This individual conducts interviews with the person in question, their family members, caregivers, and even professionals involved in their care.
The investigator delves into various aspects:
* How does the individual handle daily tasks and decision-making?
* What are their living arrangements like?
* Are there any concerns about potential exploitation or abuse?
A medical or psychological evaluation is often ordered to assess cognitive abilities and determine if the person truly lacks capacity to make sound decisions. The investigator then compiles all this information into a detailed report for the court.
