Marshalling Estate Assets – Ensuring Every Coin is Counted
Certainly Lisa. One crucial step in the probate process is marshalling the estate assets. This involves meticulously inventorying all assets belonging to the deceased individual, including bank accounts, real estate, vehicles, investments, and personal property.
Consequently, a detailed list of each asset with its corresponding value needs to be compiled. This information is then formally documented in an Inventory and Appraisal form (Form DE-160/161) that’s filed with the court.
It’s vital to be thorough during this stage because any overlooked assets could lead to complications down the line. Moreover, accurately valuing each asset is essential for fair distribution among heirs and beneficiaries.
Ordinarily, this process runs smoothly. However, I recall one instance where a client’s deceased father had stashed away a considerable sum of cash in a safe deposit box that no one knew about. Discovering this hidden treasure required some detective work but ultimately ensured the rightful distribution of his assets.
Another time, I helped a family navigate a complex situation involving valuable artwork. The deceased individual was an avid collector, and identifying and valuing each piece accurately was crucial for proper estate distribution.
According to the California Probate Judges Association, approximately 70% of estates require some form of asset marshalling. This highlights the importance of this step in ensuring a smooth and equitable probate process.
