Ordinarily, you would choose someone trustworthy, organized, and capable of handling financial matters. It’s a significant responsibility, so careful consideration is paramount.
Consequently, open communication with the potential executor about your expectations and their willingness to take on the role is essential.
Notwithstanding its importance, I’ve encountered situations where individuals named an executor without discussing their intentions beforehand. This can lead to unexpected complications and reluctance from the chosen individual.
Once, a client named his brother as executor, assuming it would be straightforward. However, his brother was going through a difficult time financially and ultimately felt overwhelmed by the responsibility. It highlighted the importance of open dialogue and ensuring the executor is both willing and able to fulfill their duties.
Remember, according to a study by Caring.com, 60% of Americans don’t have a will. Selecting an executor is a crucial step in protecting your loved ones and ensuring your assets are distributed according to your wishes.
