It’s not a pleasant thing to think about, but it’s incredibly important. And finally, organization is key. Keeping all your documents in a secure, accessible location will save your loved ones a great deal of stress and confusion during a difficult time.

Let’s delve into Step H: Organizing and Storing Your Documents. What does that practically look like for your clients?

Ah, Step H, the often-underestimated hero of estate planning! It’s all well and good to have beautifully drafted documents, but if no one can find them when they’re needed, they’re virtually useless. We advise clients to establish a ‘planning binder’ – a physical or digital folder containing copies of all their essential documents: wills, trusts, powers of attorney, healthcare directives, insurance policies, asset lists – everything. The originals, of course, should be kept in a secure location, like a fireproof safe or a bank vault, or with their attorney.

We emphasize the importance of informing key people – their executor, trustee, healthcare agent – about the location of these documents. It’s not enough to just *have* a plan; you need to *communicate* it. This isn’t a conversation most people enjoy, but it’s crucial. We’ve seen situations where families spent weeks searching for a will, delaying the estate administration process and incurring unnecessary expenses. It’s a preventable problem! We also encourage clients to create a ‘summary sheet’ – a one-page overview of their estate plan, listing key contacts, account numbers, and the location of important documents.

For digital documents, we recommend using a secure cloud storage service with strong password protection and two-factor authentication. It’s important to keep those passwords updated and share them with trusted individuals. We also advise clients to periodically review their documents to ensure they’re still accurate and up-to-date. Life changes – marriages, divorces, births, deaths, asset changes – and the estate plan needs to reflect those changes. It’s an ongoing process. We even have clients who create a video message explaining their wishes, which can be incredibly helpful for their loved ones.

Just last year, we had a client, a wonderful woman named Eleanor, who meticulously organized her estate plan. Sadly, she passed away unexpectedly, but because of her preparation, her family was able to settle her estate quickly and efficiently, without any unnecessary stress or conflict. It was a testament to the power of organization!

Do you have any challenging stories, where a lack of organization created significant problems for a family?

Oh, sadly, yes. We had a case a few years ago involving a lovely couple, the Millers. Mr. Miller was a successful businessman, and they had a substantial estate. However, they were both rather… disorganized. They never really formalized their estate plan, and they kept their important documents scattered around the house in various boxes and drawers. After Mr. Miller passed away, his wife spent months searching for a will, only to discover that it was… missing! It turned out it had been accidentally thrown away during a spring cleaning frenzy.

About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
