I had the pleasure of sitting down with Ted Cook, an Elder Protection Attorney here in beautiful San Diego, to discuss a topic crucial to our aging population.
What Are The Biggest Challenges You Face When Protecting Elders?
“One of the biggest challenges I face is overcoming the perception that elder abuse is only physical,” explains Ted. “It can be financial, emotional, or even neglectful. Many times, the abuser is a trusted family member or caregiver, making it difficult for the victim to recognize and report the abuse.” He continues, “We need to educate our community about all forms of elder abuse so that we can identify and address these issues more effectively.
Can You Walk Us Through The Steps Involved In Protecting An Elder?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Let’s Dive into “Protective Actions.” What Does That Entail?
Ted takes a deep breath and says, “‘Protective Actions’ is where we often see the most urgency. Depending on the situation, we might need to immediately seek a restraining order against an abuser, alert Adult Protective Services, or even petition for guardianship or conservatorship.” He elaborates further:
“Think of it like building a shield around our vulnerable clients. We need to stop the immediate harm and then put measures in place to prevent future abuse.”
Ted emphasizes that financial protection is crucial during this phase. This might involve freezing bank accounts, revoking power of attorney if it’s being misused, or even preventing unauthorized sales of property.
“We want to ensure the elder’s assets are safe and accessible for their care,” Ted states.
One particularly challenging case Ted recalls involved a family member who was systematically draining an elderly woman’s bank account.
“It took some investigative work, but we were able to freeze the accounts in time. The relief on our client’s face when she realized her finances were secure was incredibly rewarding.”
