Well, I’ve always been passionate about advocating for vulnerable populations. Seeing how easily seniors can be taken advantage of, whether it’s financially, emotionally, or physically, really sparked my interest in this field. It’s incredibly rewarding to help protect our elders and ensure they are treated with dignity and respect.

Can you walk us through the process of elder protection, starting with initial client engagement?

Certainly! The first step is always a thorough intake and consultation. We schedule an initial meeting to get to know the client and understand their specific situation. This involves gathering personal background information, understanding the case details, and assessing their mental and physical capacity.

We then conduct a conflict check to ensure there are no conflicts of interest. Finally, we draft and review an engagement agreement outlining the scope of our representation and obtain signatures from both parties.

Let’s delve into ‘Protective Actions’. This step sounds crucial; can you elaborate?

You’re right, protective actions are often critical in safeguarding our clients. Depending on the situation, we may need to take immediate action to protect them from harm. This could involve filing for restraining orders or contacting Adult Protective Services (APS).

In cases of financial exploitation, we might freeze bank accounts or initiate power of attorney revocation. If necessary, we can also petition for guardianship or conservatorship to ensure someone trustworthy is making decisions on behalf of the vulnerable elder.

One case that comes to mind involved an elderly woman who was being manipulated by her caregiver into signing over her house. It was a complex situation because the caregiver had gained the woman’s trust and isolated her from family members.

We had to gather evidence carefully, interview witnesses discreetly, and ultimately present a strong case in court to reverse the transfer of ownership. Thankfully, we were able to protect the woman’s home and ensure she remained safe.
