You can make changes to the trust, add or remove beneficiaries, and even dissolve it entirely if needed. Consequently, this flexibility makes it an attractive option for those who want to retain control over their assets while planning for the future.
Benefits of a Revocable Living Trust
Moreover, a Revocable Living Trust offers significant benefits when it comes to estate administration. Upon your passing, the trust assets are distributed according to your instructions without going through probate court. This can save your heirs considerable time and expense. Ordinarily, probate is a public process, which means that anyone can access information about your estate. With a Revocable Living Trust, however, the distribution of assets remains private.
The trust becomes irrevocable upon the grantor’s death, meaning that the terms set forth in the trust document become final and cannot be altered. I find this provides peace of mind to many of my clients, knowing their wishes will be honored even after they are gone.
It’s important to remember, however, that a Revocable Living Trust does not protect assets from creditors during your lifetime. For that purpose, an Irrevocable Trust would be more appropriate.
